If you received notice from CBIZ Benefits & Insurance Services, Inc. (“CBIZ”) indicating that your Private Information may have been compromised in the Data Incident, which occurred in 2024, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) all persons who timely and validly request exclusion from the Class; (ii) the Judge assigned to evaluate the fairness of this Settlement (including any members of the Court’s staff assigned to this case); (iii) Defendant’s officers and directors; and (iv) any other person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the occurrence of the Data Incident or who pleads nolo contendere to any such charge.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by December 24, 2026.

This Settlement provides eligible Class Members with (1) up to $5,000.00 in reimbursement for Out-of-Pocket Losses consisting of actual documented out-of-pocket losses or expenses that are fairly traceable to the Data Incident, and (2) a cash payment of approximately $100.00 (assuming a claims rate of 10% of the roughly 19,990-person Settlement Class) that will be pro rata increased or reduced based on the money remaining in the Settlement Fund after the payment of attorneys’ fees and costs, Administrative Expenses, Class Representative Service Awards, and valid claims for Out-of-Pocket Losses. Under this Settlement, the maximum total amount Defendant may be required to pay is $485,000.00. In no event shall Defendant’s total financial obligation under the Settlement exceed $485,000.00. A Class Member may submit a claim for Out-of-Pocket Losses and a claim for a pro rata cash payment.

Out-of-Pocket Losses. Class Members may claim reimbursement for documented out-of-pocket losses or expenses incurred in or after 2024 as a result of the Data Incident, up to a maximum reimbursement of $5,000.00. The benefit covers eligible losses or expenses like:

  • unreimbursed losses relating to fraud or identity theft

  • professional fees including attorneys’ fees, accountants’ fees, and fees for credit repair services

  • costs associated with freezing or unfreezing credit with any credit reporting agency

  • credit monitoring costs that were incurred on or after the Data Incident through the date of claim submission

  • miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges

  • other mitigative costs fairly traceable to the Data Incident that were incurred in or after 2024 through the date of the Settlement Class Member’s claim submission

You need to submit proof, like receipts or other documentation not “self-prepared” by the Settlement Class Member concerning the costs incurred. “Self-prepared” documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement, but can be provided to clarify or support other submitted documentation. These claims must be supported by legitimate documentation.

Pro Rata Payment. All Class Members may claim a cash payment of approximately $100.00 (assuming a claims rate of 10% of the roughly 19,990-person Settlement Class) that will be pro rata increased or reduced based on the money remaining in the Settlement Fund after the payment of attorneys’ fees and costs, Administrative Expenses, Class Representative Service Awards, and valid claims for Out-of-Pocket Losses.

The deadline to submit a Claim Form online is December 24, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than December 24, 2026.
